Fourth Circuit Arguments in Appeals from the District of Maryland, December 2025

Below is a list of appeals from the United States District Court for the District of Maryland being heard during the Fourth Circuit sitting that begins December 9, 2025. When available, we include the Clerk’s synopsis of the issues.

To compile this list, we’re going only by the district judge’s name, which can be overinclusive (if a Maryland-based judge was sitting by designation elsewhere within the Circuit) or underinclusive (if an outside judge was sitting by designation in the District of Maryland). 25-1312 International Painters and Allied Trades Industry v. Florida Glass of Tampa Bay, Inc. (Gallagher)
ERISA: Whether district court erred granting summary judgment in favor of multi-employer pension plan in action to collect withdrawal liability and additional statutory damages under ERISA.

23-1235 Randy Richardson v. Prince George’s County (Hazel)
CIVIL: Whether district court correctly dismissed equal protection claims related to plaintiff not receiving business permit for lack of Article III standing and unripeness.

25-1121 Garnell Walls v. Prince George’s County (Boardman)
CIVIL: Whether district court erred in dismissing Fifth Amendment takings claim on ripeness grounds, concluding Burford abstention would apply if claim was ripe.

25-1430 Kristin Simmons v. UM Capital Region Health, Inc. (Maddox)
CIVIL: Whether district court erred granting summary judgment for employer on claims under ADA for disability discrimination, under FCA and MFCA for retaliatory discharge.

25-1288 Beltway Paving Company, Inc. v. Pruco Life Insurance Company (Hurson)

CRIMINAL: Whether officer had reasonable suspicion to stop Defendant’s vehicle based on window tint or license plate; application of good faith exception.

21-4541 US v. Clifton Mosley (Hazel)
CRIMINAL: Whether the evidence was sufficient to sustain Mosley’s various witness-murder convictions; other issues.
